1. INTRODUCTION

Welcome to Van Ardi’s Website! These Terms and Conditions (hereinafter referred to as “Terms” or “Agreement”) govern your use of the www.vanardi.com (the “Website”) our products and other services offered by Van Ardi (collectively, the “Services”).

Please read these Terms carefully. By visiting our Website and/or by using the Services, you acknowledge that you understand and agree to be bound by these Terms including our Privacy Policy.

By placing an Order, you represent to us that you are over 18 years of age at that time. If this representation is untrue, there will be no Agreement between us and we will have no liability to you.

Below are the some basic terms of transactions, purchasing, delivery, payment and other  activity done through our Website.

We reserve the right to update, change, or replace any part of these Terms at our sole discretion.

2. INTELLECTUAL PROPERTY RIGHTS

Van Ardi LLC is the owner or the licensee of all copyright, design rights, database rights, trademarks and other intellectual property rights on this Website, and in the material published on it.

Your use of the Website grants no rights to you in relation to our intellectual property rights or the intellectual property rights of third parties. All such rights not expressly granted are reserved.

Subject to the following Agreement, you may not modify, copy, translate, broadcast, perform, distribute, frame, reproduce, republish, post, transmit or sell any content or intellectual property appearing on this Website. You agree not to change or delete any ownership notices from materials downloaded or printed from the Website. 

You may print or otherwise copy materials published on this Website for personal use only, provided that any copy of these materials which you make retains all copyright and other proprietary notices. 

If you print off, copy or download any part of this Website in breach of this Agreement, we reserve the right to suspend or terminate your use of this Website immediately and you must, at our option, return or destroy any copies of the materials you have made. Infringement of any intellectual property rights may result in legal action being taken against the offending party.

3. PRODUCTS & PRICES

The submission of an order determines contract conclusion and therefore creates for the customer the obligation to pay the price, taxes and possible further fees and expenses, as specified.

Every effort is made to ensure that prices shown on the Website are accurate at the time you place your order. If an error is found, Van Ardi will inform you by email to the address provided in your order form as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, Van Ardi will refund you for any sum that has been paid by you.

In addition to the price, you may be required to pay a delivery charge for the goods, as shown during the checkout process on the Website. If you do not agree with the delivery price stated during checkout then you do not have to proceed with your order.

Van Ardi cares about the security of its customers. Van Ardi does not process and does not store payment title data (e.g., credit card numbers), which are treated and/or kept by relevant payment service providers. Only after payment transaction has taken place, the banking service provider informs Van Ardi about payment outcome, without disclosing any sensitive information. For this reason, Van Ardi is not responsible for any refusal of the credit card used for payment. Van Ardi cannot therefore be held responsible in any way for direct or indirect consequences of credit card use to pay for ordered products and/or services.

4. DELIVERY

You will need to provide us with your e-mail address and mobile number so that we can notify you as soon as possible to confirm receipt of your order.

All products are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available in stock.

The products you order will be delivered to the address you give when you place your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

When placing your order you may wish to contact us with instructions for delivery alternatives in case you are not in.

If multiple delivery attempts are made to the provided delivery address and a competent recipient is not present to sign for the goods, or no effort is taken by the recipient to contact the courier to arrange re-delivery, the order will be returned to our warehouse. In this instance, a delivery surcharge may need to be paid by the customer in order for the goods to be re-delivered. The Company will contact you and provide you with a quote.

5. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in all respects in accordance with the laws of the Republic of Armenia. Disputes on this Agreement are resolved through negotiations. In the event of non-agreement, disputes shall be subject to Courts of General jurisdiction of First Instance of the Republic of Armenia.

6. CHANGES TO TERMS AND CONDITIONS

You can review the most current version of the Agreement at any time at this page. 

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our Website. It is your responsibility to check this page periodically for changes. Your continued use of or access to our Website or the service following the posting of any changes to this Agreement constitutes acceptance of those changes.

RETURN AND REFUND POLICY

This Return and Refund policy (hereinafter referred to as the “Policy”) is an integral part and a separate legal document, binding on Van Ardi and our customers. It outlines, return and refund procedures, parties’ rights and obligations and other selling – buying provisions related to the sale of products.

Van Ardi has the right to change this Policy at any time, having regard to the legislative requirements.

1.GENERAL PROVISIONS

Although we have made every effort to display the colors, images and descriptions of our products as accurately as possible, upon delivery the customer can open the product immediately to check its compliance with the qualitative and quantitative features presented on the Van Ardi’s website (“Website”).

Due to the nature of our business and products we sell, purchased products are not eligible for a refund. We also cannot process any product replacements or accept any returns for products ordered through the Website. We want to ensure that your experience with our wine is as exceptional as the Van Ardi wine. However, once the product is shipped it is considered purchased and cannot be refunded for any but the reasons outlined below. All risk of loss and damage to the product passes to the customer upon delivery. 

2.FLAWED PRODUCTS

Van Ardi guarantees the quality of the wines we sell. By law, we cannot accept returns of alcoholic beverages unless the product is corked or flawed. If you believe that you are in receipt of a corked or flawed bottle of wine and would like to exchange it, please send an email to [email protected] within three (3) days of opening the bottle. We ask that you return the unfinished portion of the original bottle for testing and replacement or refund. 

Upon receipt and inspection of the returned product, we will send you an email to let you know the status of your return. Replacement bottles of the exact product are subject to availability and may not be possible. Refunds will be applied to the credit card or other original method of payment within one (1) month. Items to be returned are subject to evaluation by our staff, and must be accompanied by your original sales receipt. 

Upon receipt and inspection of the returned product, we will send you an email to let you know the status of your return. Replacement bottles of the exact product are subject to availability and may not be possible. Refunds will be applied to the credit card or other original method of payment within one (1) month. Items to be returned are subject to evaluation by our staff, and must be accompanied by your original sales receipt. 

Since we cannot control how bottles are stored once they leave our possession, we will only accept bottles for exchange within thirty (30) days of purchase.

3.DAMAGED ON DELIVERY

If you receive your wine and it has been damaged during shipping, please email us at [email protected] within three (3) days of receiving the shipment. Please include a description of the damages and pictures, if possible. This information is extremely helpful to us in making sure that our products are packaged and shipped properly. We will arrange for the damaged products to be replaced.

During the busy holiday season we try our best to guarantee your order will arrive on time, but due to extremely high order volume and unexpected weather situations beyond our control, there might be a slight delay in delivery of your order. If we miss our delivery guarantee due to an error on our part, we will refund your shipping. Understandably, no refunds can be issued for orders delayed due to adverse weather conditions or any unforeseen circumstance that may affect Van Ardi Winery or any of our shipping carriers. If it turns out that the defects arose after the transfer of the product to the consumer, or the actions of third parties, or force majeure, Van Ardi is not liable for refund and will not accept returns.
